Lawmakers could first concentrate their efforts on correcting the glitches in the system that affect legal immigration, before turning to illegal immigration. After all, if the legal process was more efficient and less daunting, perhaps the illegal immigration problems wouldn't be quite so bad.

now days there is a SEPRATE quota for RETURNING WORKERS in Us consulte for renewing stamp. I used it 6 months ago. I Went to VFS on 23rd Nov 2005 and got appt for 30th Nov for stamping @ mumbai consultate. Got stamped and collected passport same evening in person.

I will try to answer to the best of my knowledge but I am not an attorney.
Your case fall in family based 2A preference, the PD date on which is July'02, which implies people in your situation who applied in July'02 are being adjudicated. So obviously, thats not an option for you, if you want to come immediately.
You child can come here on vistor visa. The issue you will run into is that even though visa can be granted for 10 years but she cannot stay for longer than 6 months at a stretch and some months gap before re-entring in the USA.
Second option is writting to consulate and department of state to issue visa on compassionate grounds. Issuance of such visa is rare but they are there. You probably will need to show extreme hardship and very few (even attorneys) are in position to advise you on this matter.
So my suggestion will be to go to your nearset consulate and discuss the matter with consulate officer/visa officer.
I and my spouse both have green card. We have a kid who was born in INDIA. He has not visited USA till now. The kid is about 2 years.

But in my case, the kid is 2 years AND also not sure what is the procedure now. Is it still true by default the kids automatically gets the green card at port of entry (Is there any age limit I hope may be till < 13 yrs) if parents posses valid green card. Please help me in this situation.

I dont think USCIS will again match your education with labor now at 485 stage in normal circumstances unless there is some fraud. 485 is more about your name check and fingerprint check along with if you were ever out of status. The only thing they can ask again is a new employment offer letter.

Chief executives of several major corporations, including Hewlett-Packard, Boeing, Disney and News Corp., are joining Mayor Michael Bloomberg to form a coalition advocating for immigration reform — including a path to legal status for all undocumented immigrants now in the United States.
The group includes several other big-city mayors and calls itself the Partnership for a New American Economy. It seeks to reframe immigration reform as the solution to repairing and stimulating the economy.
Bloomberg and Rupert Murdoch, chairman and CEO of News Corp., appeared together Thursday on Fox News to discuss the effort.
"We're just going to keep the pressure on the congressmen," Murdoch said. "I think we can show to the public the benefits of having migrants and the jobs that go with them."
Bloomberg added, "Somebody has to lead and explain to the country why this is in our interest."
The CEOs said Thursday in statements that their companies — and the nation — depend on immigrants.
"It's our great strength as a nation, and it's also critical for continued economic growth," Walt Disney Co. Chairman and CEO Robert Iger said in a statement. "To remain competitive in the 21st century, we need effective immigration reform that invites people to contribute to our shared success by building their own American dream."
The group says it intends to make its point to policymakers by "publishing studies, conducting polls, convening forums and paying for public education campaigns."
The tactics are similar to those used by Bloomberg's coalition of mayors who support gun control.
Bloomberg has for years criticized the federal government for its immigration laws, proposing in 2006 a plan that would have established a DNA or fingerprint database to track and verify all legal U.S. workers.
The billionaire mayor, a former CEO of the financial information company Bloomberg LP, also said at the time that all 12 million undocumented immigrants in the United States should be given the opportunity for citizenship, saying that deporting them is impossible and would devastate the economy.
Lawmakers who wanted to deport all illegal immigrants were "living in a fantasy world," he said.
He has recently taken up the fight again, declaring this week that U.S. immigration policy "is national suicide."
"I can't think of any ways to destroy this country quite as direct and impactful as our immigration policy," he said Wednesday. "We educate the best and the brightest, and then we don't give them a green card."
The group's main immigration goals are to secure the borders, develop an easy system for employers to verify work eligibility, hold companies accountable for breaking the laws and improve the use of technology to prevent illegal immigration.
The group also wants more opportunities for immigrants to join the U.S. work force and a path to legal status for all undocumented immigrants.
Bloomberg spokesman Jason Post said no money has been spent on the effort yet, and he could not say whether the group will be a standard nonprofit, a political action committee or a group known as a 501(c)4 nonprofit, which can operate outside the more strict limits governing political action committees.
The business leaders in the coalition employ more than 650,000 people and make more than $220 billion in annual sales, combined.

Take the offer on EAD as you are now legally eligible to do.
In the unlikely event that something happens to your 485, you could then approach the program and ask them to do a H1 visa for you, otherwise you would have to leave the program. They would likely not risk losing GME funding.
Nowadays getting a good fellowship has gotten rather difficult, I'd consider taking the small risk involved.
Consult a good attorney to get their professional advise.

but usually dates opens up if any cancellation. check vfs site often. nowadays it is easier to get appt than it used to be.

THe Lottery is the dumbest piece to obtain GC. Imagine some guy who does nothing to the USA applies, comes here sucks the $$ out of the system by coming here, staying here and enjoying all monetray benefits of a GC like unemployment benefits etc
People who have been paying taxes for 6-10+ years and working in the US economy get only 50,000 Green cards a year, while 50,000 complete strangers in a foreign country get Green card in a year because they happen to be lucky and win a lottery !! :mad:

May be we should gather momentum, and ask ImmigrationVoice to start working to address the issue of past backlogs as well as future backlogs too. Moderators, please make a note of this thread and direct us on path forward. May be another flower revolution; or may be we should send pens saying "Change the immigration law and make US a beacon of freedom". This will decide the fate of millions of people in US waiting for their GC approval.

Yes I was called for an in person interview and after the interview was told that the case is approvable. All the checks have been done and I just need a visa # to get the GC. I do not know how and why I was called for interview but I was the amonst the day 1 filer in July 2007. My application had reached on Jul 2 2007.
Here is the answer! Your filing date was July2, 07. If you filed with NSC, in Feb they had moved their processing dates to July 18th. So your case was assigned to officer for review and he called for interview!.
Then he made a decision: Case approvable pending visa availability!

My case went directly to CSC for H1 extension and is pending since July 10 any idea others have same problem.

I am also in the same boat. I have my Masters in Mechanical Engineering. I had filed for H1B with companies A & B as Mechanical Engineer and have worked with them for 1.5 years each.
Recently I had switched to desi company (C) and had to file my H1B as Software Engineer. I got my H1B without issues. I am crossing my fingers and planning to apply for Labor Certification as Software Engineer in EB2. (MS -Mech Engg + 1 year experience).
Other members pls share your experience if your case is simillar. I know lot of people who did their masters in other fields and changed to Software when they were in OPT. But do not know some one who has worked in H1b as Mechanical engineer and then got another H1 as software engineer. Has anyone with my simillar background, gone past the I140 stage?

It is all depend on how your employer specifies the education requirement for the position in LC. If that position requires engineering in any branch, then you will be fine. Otherwise, if the position requires education in particular branch and if you do not have that branch of study, then it may be a problem in LC or 140.
