    Look man, I don't know who you are and what's your story. But I do know this. Giving a false impression to others and misleading others on this forum and on any other forum is not going to help. You seem to project that only you care for the issue of country-limits. I think the better description is, you only care for the removal of country limits till the day you get your green card. You do NOT want to remove country limits on EB beyond the date you receive the approval of your application. Giving a false impression to a few on this forum that temporarily removal of country limits will be easier than permanent removal of country limits is just WRONG.

    After IV admin posted for the media interview few days back, I sent them an email expressing my willingness to speak with the press. I spoke with Vivek Wadhwa at length last week about this issue. Vivek Wadhwa article in Washington Post covers the issue of country limits where as his previous articles have not covered this issue.

    I also called a member of IV core yesterday evening and they told me that they have told you not to do whatever that you are doing. I was told that you are hurting their effort and you have been told this pretty clearly. But you continue with this senseless and direction less ranting and you continue to cause damage to the effort for the removal of country-limits.

    Its disgusting that rather than working with others to fix this complicated and difficult issue, you continue to beat your own drum, without actually doing anything, but at the same time hurting the issue you claim you care for. And on top of that you want to remove the country limits only until you get your green card. Is that rationale to you in any which way?????? No. Is your action selfish????? YES.

    Good point, has anybody asked this to any lawyer ? Can we challenge this in court ? This is the definition of judiciary review...If we can proove the country cap to be unconstitutional..

    Judicial Review is when the Supreme Court reviews an act of Congress to see if it is Constitutional.
    Judicial Review is the power of the Supreme Court to declare a law unconstitutuion (violation against the laws of the Constitutuion).

    Hi,

    Yesterday I got the response for my SR opened on 10/16 for still not receiving FP notice yet. The letter says that the processing on my case has been delayed since the background check on my application is still open. Please contact after 6 months if you still haven't heard back from us. My assumptions are:

    1. Since they did not mention any where in the letter about biometrics, they are talking about my 485 petition and not my finger printing notice. Guess they misunderstood why I opened the SR with them. Does that make sense?

    2.Is it possible that I haven't received FP notice since my background check is still in progress? I thought that these were two independent process...

    Any suggestions would be appreciated!

    FP is definitely not connected to background check. I am sailing in the same boat. My application date was july 17th and notice day was Sep 10th. I opened a SR 45 days back with no response. NSC-TSC transfer case..:confused:

    I have to get the EMP LETTER latest by Friday June 29th from employer.
    For that i have to sign the agreement by June 28th Noon time.

    Today is June 26th and they are still working on agreement with their lawyers and would probably give me the final agreement tomorrow 27th noon time.

    Between 27th Noon and 28th Noon how can i consult a lawyer ??


    I meant "whole sentence from the employment agreement". All depends on the wordings. If your agreement is linked to I-485 approval date then there is a way out. Every contract must have well defined terms. Since date for I-485 approval is not known, such contracts are difficult to stand in court of law. However, if it says "the employee must work for 2 years or 6-months after I-485 approval date (whichever is earlier) otherwise he/she will pay all GC related expenses" then the contract is more likely to be enforceable.

    All depends on the wordings of the contract.

    Please consult a good lawyer BEFORE signing any contract.

    As we get closer to election day it seems that Democrats will have control of the Congress. All the polls that have been and are being conducted show that the Democrats are leading the Republicans by double digits.

    If Democrats win the CIR will get through but the there will be a huge backlog as there arent enough people at USCIS to do the work, which in a way is retrogession. There will be relief for people with advanced degrees but on paper only.As it will still take years for their paperwork to get through USCIS, others will be in a worse situation as the waiting line would be huge.

    If Republicans win there will be no CIR as pointed out by others in the thread. However, SKIL might get through and that will help shorten the waiting period for people without advanced degrees.

    Based on my analysis (which might be completely wrong), I think we are better off with Republicans.

    At least with DEMS there is close to surety of passing one Immigration Bill even if it is CIR.... With REPs, we will never see any bill the light of day... Not sure which world you live in but check out numbersusa site and you will see how they are trying to decrease the immigration - legal or illegal alike.... So while Skill will go through Senate, it will be again blocked in house like it was in Dec2005........ So bottomline is that I would rather have some bill passed and have a hope in sight than no bill and never know if one will ever get GC

    I have to say this is the first time ever that I want my checks cahsed very soon when my natural tendency is wanting to hold onto money in the checking account as long as possible. I am, too, waiting for the day to see canceled checks for AOS, EAD & AP. I've been obssessed to check the latest news on USCIS' broken system, and it is a nice break to amuse myself about this whole check cashing business.

    Hang in there, everyone. There shall be a light at the end of the tunnel. I hope and pray that the light comes before I retire ;)

    Hi guys,
    My first H1B (2003) had LUD on 14th of July...and today there is a LUD on I-140. My I-140 approved in March 2007..PD is March 2005...Is it good indication that they are doing something with my I-485 case? My application reached NSC on july 2nd (not sure about time as my lawyer sent those papers). My I-140 is from TSC.


    Today i added my old H1B (2003) case to my portfolio..i saw LUD on it...LUD date is '14th july 2007'...not sure...14th july is saturday...but no surprise...i saw lot of people posted that their LUD was on weekends....Is it good indication? sorry if i am asking unnecessary question..

    IV is trying to get rid of retrogression which is a great goal. However, this very thing has caused hundreds and thousands of children to age out. Would it be awful to add this into the matter. I know our lives have been put on hold waiting and waiting but some of our childrens lives have been thrown down the pan in that time. We will eventually have passage to permanent residency they will not.

    Totally agree with you. Its so unfair for people who are waiting for a loooooog time. And suddenly find themselves as being left out.

    We came to know only few of the once who have posted in other forums that they got GC with PD as fresh as Jan2007, and they posted it in the forum because they were afraid if their GCs would ever be reverted....
    So, I think there are probably a lot more out there who might have got the GC and are keeping it quite, so that they don't stir up the folks who are waiting so patiently (which of course is weaning thin by the day!!).

    Totally unfair, unjustified.

    Maybe we should..........

    1) Send letters to USCIS, highlighting the plight of those waiting patiently and folks who joined recently got the GC. Send anonymous letters if you fear of being put under the scanner.

    2) All the IT folks who are here in the US are probably in the higher 10% bracket. Maybe we all should collectively hire a lobby group in Washington. That's the only solution, it works well.

    Thats all I can think of right now....

    Yup, there are a lot more with PD's in 2006 who got their GC then what's evident in the forums. Most of them have like 3 posts on the forum, and Lo and behold.. the only time they wanna post something it's the news about their GC approval.... STINKS!!

    Sending Letters and Lobbying is a good idea.. I support anything which will draw media attention to this scam.... just want USCIS to be exposed.. maybe even lure an honest journalist ( TIMES Magazine or Fortune ) to do an editorial about the wrong policies of USCIS.
    I would say that they will be interested, as they love exposing Govt agencies in general.


    To all you folks against the lawsuit, how does this idea sound ?

    If anyone has a better idea, I am willing to listen.

    The Intent & Implicatins could easilty be challenged....I need not have to write how intent could be challenged, as fa as implications are concerned, country cap has given grief to certain section, while they are still living in the country...
    Do we have any reference to say it is unconstitutional ? If EB country cap is unconstitutional, FB cap would be unconstitutional too.

    IMO this entire country cap rule has racist intent. If the caps were to promote diversity, the cap should be based on ethnicity of US population (ctizens and GC holders). Are Indians and Chinese a a mjority in this country ? No.

    How does putting a cap on total visa allocation per year promote diversity ?

    Dont know how far it is true, but I always look at that website. And usually they update the happenings quickly. And most of the time it is correct too.

    And in my office, they applied for three of us and one has got the RNs. But we haven't. Attorney says that she has got RNs for her clients who applied in August. And asked me to wait, as nothing else can be done at this point.

    I got finger print notice on 6-16-07.
    I never got receipt notice and I could not read the number in back of my check image. My attorney even did not get any receipt notice either:confused:

    The finger print is scheduled for July 7th. I sent all app. to NCS on the June first and they transferred to TCS. PD of Sep 2003 and I-140 was approved 2005. I also apply for travel doc. and work permit but no receipt so far.:rolleyes:

    I don't think we are wasting energy/time by identifying gaps and answering questions to folks who want to know more about what exactly are we talking about here. Moving on and gaining more and more support etc., all these things need to be done in parallel.

    Wanting to know more and talking trash/dumb - 2 different things.

    If opinion polls and media coverage are any indication, it appears democrats shall rule
    the house.

    For us the best congress would be the one which passes SKIL bill.

    It was unfortunate that despite Republicans ruling the house, they did not even discuss
    anything on immigration, specially for high tech skilled workers, even though SKIL was
    introduced by Republican leaders.

    I hope they do *something* during lame duck session.

    In the first july bulletin they said they would retrogress in September and we all had planned accordingly and now this Incompetence is just not resonable.

    I don't know why what (s)he has done to India or U.S or any other place should be any of our business? What has that got to do with his/her depression about not receiving GC? Why is that as soon as someone poses a simple question, people tend to get on the moral high-horse? BTW, the poster never said (s)he is going back yet.

    2: just don't lose hope. Your day in the sun will come. I am kinda in the similar situation as you are too (came in 1999, PD of 2002, was in the labor backlog for 5 years...). Just keep your chin up. As someone else said, you are getting closer to your GC.

    In my opinion most people who are on H1 n IT with american companies, either got in there via OPT- H1 or H1 transfer.


    That is very true! In very very extreme cases, you would find American companies recruiting directly from India for IT jobs! That may be like, one in 1000!
